SCRANTON — A man paralyzed from a gunshot wound inflicted by a Wilkes-Barre police officer has filed a federal lawsuit against the city police department and Plains Township police.
James Rankin, 23, of Carnegie, filed the three-count suit in U.S. District Court in Scranton on Wednesday through attorney Jack M. Bernard of Philadelphia. He is seeking $150,000 on each count.
Rankin is facing aggravated assault and other charges in Luzerne County Court related to a home invasion of an apartment at 251 Kidder St. on April 9, 2012. Rankin allegedly used a Taser to stun Naeem Ford and Magarita Martinez during a fight inside the apartment, according to the criminal complaint.
Rankin jumped through a third-floor window and was chased by city police. Police pursued Rankin around the block as an officer fired when Rankin reached toward his waistband, the complaint says.
District Attorney Stefanie Salavantis cleared the officer of any wrong-doing after an investigation by state police at Wyoming.
But in his suit, Rankin states he was unarmed when officers falsely yelled he was in possession of a gun. He says police failed to use other reasonable means to control and contain the situation before using excessive and deadly force.
Rankin alleges officers had him “boxed in” and were aware of his location during the foot chase.
A day before the shooting, Rankin stated, he had a “frightening experience” with city officers who found him under the porch steps of a residence. Officers told Rankin to “immediately leave town” or they would shoot him, the suit states.
Rankin says the shooting left him paralyzed from the waist down with limited use of his legs. He states he experienced second-degree burns that required skin graft surgery, bed sores, kidney failure and extreme weight loss among his physical disabilities caused by the gunshot injury.
Named in the suit are Wilkes-Barre Police Chief Gerard Dessoye, former Assistant Police Chief Donald Crane, 12 officers, Plains Township Police Chief James O’Malley and two township officers.
