to not mislead our folks along the way toward helping out rather than adding better to worse, i'm posting an outlined procedures normally take place in similar cases like Liang's, this was drafted by an individual with legal background, the purpose of this was to keep us informed of what it takes in the legal process, here below is the outlines fyi:
1. district attorney files charge in a felony.
2. grand jury reviews the charge and evidence in secret. in this case, Peter had the opportunity to testify or provide recorded testimony yet Liang did not.
3. grand jury decided to indict for the invalid or deficient evidence found (New York state courthouse requires 12 out 18 jury approval to put the criminal to the trial). so Liang case would go to trial.
4. next step is arraignment. arraignment is for the accused to hear the charge. judge makes sure the accused understands the charge. accused pleas guilty or not guilty. Liang had been arraigned and pleaded not guilty.
5. next big step is trial which will last about a year. between now and there will be many pre-trial hearings at court. both sides work on discovery process.
6. The last step judge making. the judge announced the jury's decision (need 12 out of 12 jury's approval)
while maintaining fairly committed to being helpful, i must say i am not bothered with hickups and noises along the way and meaningless speculation that once 100 K signatures collected the charges on Liang would all be dismissed, please be fair and be realistic if you want to help, thanks |
